Ex- FBI Staff Member Asserts Improper Termination Because of Pride Banner Display

A long-serving FBI operative has filed a lawsuit stating he was terminated on account of displaying an LGBTQ+ banner within his workstation.

Based on the plaintiff, that served for the FBI over a decade and a half, the firing recently is being described as “illegal and discriminatory”.

The legal filing argues that the agency infringed upon the employee’s free speech protections and took punitive measures in his case because of participating in constitutionally covered speech.

The plaintiff is requesting a legal ruling to return his position at the bureau.

Particulars of the Lawsuit

The comprehensive complaint, submitted in a Washington court in the nation’s capital, alleges that Maltinsky was terminated from the FBI academy last month over previously exhibiting the banner in his workspace.

According to the document, the Pride flag was given to the plaintiff to honor his efforts to advance the agency’s diversity initiatives.

Early on, my only desire was to serve my country and protect public safety alongside the brilliant and dedicated men and women in the bureau,” stated Maltinsky.

He continued, I showed that symbol – that previously was raised before a federal building – not to make a political point, but as a representation of acceptance, solidarity and impartial service.

These principles that once made the FBI strong. Now it is a place where people like me face discrimination. I believe I was terminated not because of who I am, but rather because of what I represent: a homosexual man,” he said.

Sudden Firing Just ahead of Graduation

Recently, the employee was accepted into the bureau’s agent training program at the FBI facility, until what he described as “unexpected firing just three weeks before completion”.

The complaint additionally states that eventually after the 2017 inauguration, a co-worker expressed an alleged concern to the overseeing official regarding the presence of the LGBTQ+ symbol.

“Out of an abundance of caution, the employee requested that the legal advisor at the L.A. office assess if the presence of the Progress Pride flag was permissible,” the document said.

It added, The advisor told the employee that showing of the flag complied with the agency’s standards.”

Notice of Firing

Nevertheless, on 1 October, Maltinsky was informed of his firing.

In correspondence referenced in the complaint, FBI director the director wrote, I decided that you demonstrated improper judgment with the presence of a political symbol in your office while previously assigned in Los Angeles.

“Pursuant to federal law of the Constitution, and statutes of the U.S., your position with the FBI is concluded.”

Lawyer Remarks

In a release provided recently, Maltinsky’s lawyer the attorney remarked, The government’s wrongful dismissal forms part of a broader effort to purge public offices of staff with alternative perspectives, or represent marginalized groups, or individuals that oppose prejudice.

This battle is not just about him, but also about ensuring the entitlements and freedoms of every government worker.”

Bureau Reaction

The bureau refused to respond regarding the case.

Related Proceedings

This legal action is subsequent to a separate case filed in September by ex- senior FBI officials that claimed they’d been unlawfully fired.

They stated that Patel claimed he was ordered by the president’s office to terminate any official involved in a probe regarding the former president.

Additionally, the bureau terminated a nearly three-decade veteran in November after the official allegedly grew upset by reports that the FBI director used a federal plane to go to a match during which his partner rendered the Star-Spangled Banner.

The veteran, a bureau veteran for many years, was fired from his role in the FBI’s critical incident response group, which manages serious incidents and the agency’s jet fleet.
